Habeas corpus - New York Times (11/03/13)



In 1807, the Supreme Court addressed the specific question of which branch may suspend the writ of habeas corpus, ruling in Ex parte Bollman that only Congress had that authority. After the start of the War of 1812, the court again sought to curb the president’s war powers, holding that the government could not seize enemy property found on United States soil without legislative authorization.
